It is sometimes hard being the oldest Internet site selling sea glass jewelry. Over the years we have had so many incidents copying our site content, ideas and designs that just defending it could be a full time job in itself.

Though we are aggressive in confronting those individuals that copy our content and most everyone had been accommodating about removing copied content or designs.

When I helped to write the NASGA code of ethics, I thought that it would provide at least a little protection for competitors who had also joined the group. This has proven not to be the case. In my defense to some recent attacks, I am posting this on my blog.(Ironically only 1 week after posting this blog, I received notice from the NASGA that the Code Of Ethics Statement had been totally removed and combined in a streamlined mission statement with no reference to honoring trademarks, intellectual property etc....)

SO - For the Record......
We have been online for over 15 years, first as a HTML site that I made myself and that was hosted not under our current domain name but on our providers free website area....We operated at that time as By The Sea Jewelry and have been for 18 years.

The Internet was young back then so it took me hundreds of hours to hone the site, meta tags, content to get listed in the search engines...Funny enough, the site back then, no longer in existence, that always ranked above me was a slow loading homemade site as well and it frustrated me that it kept getting ranked higher as there was no content to speak of.

Genuine Sea Glass

We have been using Genuine Sea Glass as a trademark in use or TM (a Legal Definition defined by the USTPO as an unregistered mark.) Unregistered trademarks OR trademarks in use are used widely in business everywhere - See Wikiapedia for general definition or the USTPO site which starts as "Do you need to register a trademark - NO...) .

Since we do not have the time or resources to defend each incident of using this unregistered mark in court, we changed our phrase to Certified Genuine Sea Glass, we are currently working on registering this mark as to protect our interests.

Many other professional sites respectfully use instead of our TM use, Natural, Authentic, Real, Found, etc.....or variations thereof. We thank them for their respect for our intellectual property!

Website Design

Several companies have actually copied out EXACT meta tags, descriptions and keywords so much so that they still have By The Sea, in their keywords.Over time, I developed my meta tags and static site pages and was finally listed as one of the top sites under our search terms......this made us a target for new sites coming online....Thankfully, most search engines no longer use these tags to rank a site.

The tag line Sea Glass Jewelry (seaglass jewelry) or beach glass jewelry (beachglass jewelry) from By The Sea Jewelry combines Genuine Sea Glass TM (natural found sea glass) ,,,etc....was soon copied by MANY and can still be seen as a influence on many other sea glass sites.
What is Sea Glass?

We were also the first page to have a "What is Sea Glass" page from Dec 1999, which can now be seen on just about every other sea glass site online. This too has been a target of copy, in part and in whole.

Original Settings

The page above also shows a design/technique design that we originated and that has never appeared in an instructional magazine or book and which we have had copied by competitors. I challenge any competitor to demonstrate an example of this setting at an earlier date or to provide me with and article of book that exhibits this technique of setting sea glass. I am confident that they will not be able to do so.

Left is a letter from Charles Peden, co-founder of the NASGA about this setting.

Terms And Phrases

Many of the words and terms we have been using since the beginning, "Distinctive", "Specializing In" "Carelessly Discarded" bottles and glass are tumbled in the ocean form these colorful gems of the shore"

More recent terms include - "Ultra Rare" , "REMEMBER - This is the EXACT piece you will receive" and our description of English Sea Glass as EndODay (The term EndOday actually happened because my custom built shopping cart only allows for so many characters and to save on space, I abbreviated to form this term) ALSO my description that it came from a "Victorian Era Glass Factory that discarded scarps over a cliff into the North Sea", copied by a competitor EXACTLY WORD FOR WORD, and when I addressed the issue to them and explained how and why EndODay came about, this person literally told me in an email, that they just pulled that term and the phrase "Out of their A$#"........ I mean really!

While it is not unethical practice to monitor your competitors, it is unethical harass them by reference to their work and websites, making legal conclusions as to their rights and post defamatory statements online to their peers.

We have never publicly attacked this persons designs, or copy protections and in fact have defended their property when applicable (when we notified them via email that a new commercial site was using a photo I knew they owned). We have also defended other sea glass artists intellectual property pertaining to a Color Chart that was posted on our social site, deleting it as we knew it to be copy protected.

We quite frankly only wish to be left alone to do our work. One of the reasons I named my company, By The Sea Jewelry, was a desire for anonymity...

My Google Analytics have the above mentioned person hitting my site over 10,000 page views in the last two years (once last January they hit our site over 20 times in one day - note Page Count is an average not a total). Some days the person visits hundreds of pages.

Funny enough, this person continues to hit my "What is Sea Glass" (195 + times which is funny as a self proclaimed pioneer in the sea glass field, I would think they would know what sea glass is by now)!

Also my Press Page (About the Artist) page 216 or more times,,,,,(shows a trend of obsession for me that this "person" concerning my business and website) I truly feel like I am being stalked.

Once a month I check my competitors to see what they are doing, sales they offer, etc......I honestly believe that this persons using the English sea glass phrase came by osmosis by visiting my site so heavily and that they sadly may really not believe that they got it from our site.

Also more recently, this person claims a design names that we have been using online for over 5 and that are also used by at least 4 other sea glass jewelry companies are using. Their new site claims legal ownership of all phrases, slogans, designs and such, yet she does not grant the same rights or privileges to our site that has been online for over 15 years.

They have stated that we have "bullied harassed and intimated people", which if emailing someone and asking them to remove content you have written from their site, or discontinue to use a design we originated, or simply asking them for their mailing address is any of the above, well,,,,,,,,,,,,,,

This person (as of 6/18/10) states on her social that she finds this post (or attacks as she calls them) "disgusting" and that I "routinely portrays me (her) in a false light, and has initiated some personal attacks that I (she) find disgusting". She accuses me now of leaving "rude and obnoxious comments for some of our (her) members"

What exactly does she find disgusting, supporting attacks with facts and figures? (something which she is unable to do as these accusations are baseless).

-If anyone reading this finds this post "disgusting" please email me....or post a comment....I have tried to maintain my composure and be judicial.

Our Designs

Occasionally we find competitors that copy some of our original proprietary settings. The letter (below ) can in 2006 from a Maine Artist naively asking me to tell them how to make an original setting. Imagine if say, a new soda company wrote to Coke and told them they would like to get into the soda business and could Coke please tell them the recipe for the soda. She no longer uses the EXACT design but now uses a version she has made her own.....

REALLY,,,,,,,,,,I have only offered and referenced statistics and copies of emails..........I have made NO attacks on character or property rights, I have only defended mine as well as others.

It is hard for me to understand as her silver work is exceptional.

Another Sea Glass jewelry maker in Rhode Island who when I first contacted about using this design, first told me that they had "seen it in a book", then that, " their sister had shown it to them" then just that "there were only so many ways to wrap sea glass. I finished by convos with them, I ended with simply replying "Yes, and that is MY way", She then asked me for an ISBN code (International Standard Book Number not used on designs or photos), Too Funny huh?

....In researching my sales records to see if this person had indeed ordered from me (as I have had other competitors attempt to order proprietary settings and request wholesale information) , I found this individual had indeed ordered from my website about a year before. When I asked them to confirm a mailing address so that my attorney could contact them, this person claimed to be fearful that I was stalking them.......

Really, think about it, if you woke up one morning to find your neighbor had moved your car from your driveway to theirs and was now claiming it to be theirs, wouldn't YOU contact your attorney or the police. Policing the Internet is a bit harder though.

In monitoring other sites, we often find incidents of design and name and phrase theft. Below are two pics, the top one is my Ultimate Sea Glass Lovers bracelet that has been on my site for well over 4 years on the Sea Glass Ideas page.

Quite recently I found the second photo on another sea glass jewelers site, Also called The Ultimate Sea Glass Lovers Bracelet.

When I contacted this person, they immediately changed the name of the piece. It still bears evidence our influence in the industry

This artist too has some of the finest silver work online so why they would want to copy me is a mystery.

II did not pursue the design issue as I believe that most drilled sea glass of generic design.

I simply pointed out to this jeweler the "coincidence" of pieces being NAMED THE SAME and even POSED the same way.

This post is meant to counter attacks made by ONE individual concerning my reputation, legal rights, integrity and standing in the sea glass community. I hope that this post helps to clear up the disinformation that she has posted online. All 3 of the examples above are members of her social sea glass community.

We will continue to monitor our competition & YES, continue to defend our designs and content we ask only to be left alone. All we ask if for our competitors to

"Do your own work" and use your own words.

Take inspiration but develop your own skills and talents.

With a very busy Full Time business, we have little time to pursue issues as stated in this blog. Most people we contact that have used our content or designs are very gracious and accommodating and we thank them for their professionalism.

Many of these items will travel with us to our next show i Manteo North Carolina at the New World Arts Festival. A juried fine arts and craft show on Roanoke Island home of the Lost Colony.

Our June Artshow Trip
10 Days - 6 states - 2000+ miles AND Tons of smiling faces

On Our Trip.............The major highlight of the trip for me came in from of 2 encounters, one with a fellow artist and one with a new client...It was the last day of our shows on the OBX when this lovely lady approached our booth "oohing" and "ahhing" over our Gallery Edition pieces..........After viewing just about every piece, She was strongly attracted to a pair of perfect vivid aqua English sea glass earrings and a classical fine silver set multi fine set pendant.........within 2 hours she must have come back 2 or 3 times, the last time trying on both and making a purchase..........While we were concluding the transaction, she shared with me that she had lost her husband, a tear moistening the corner of her eyes,,,,,,,I of course, replied with the usual "I am so sorry"....having lost my father to cancer not so long ago, I was very aware of the grieving process and know that sometimes people just need to talk about losing someone close to them.............You could tell she wanted to share but hesitated as we had just meet.............As you see, we had become close in a short time chatting while she was looking over our creations............

Later in the day, a group of 4 ladies come up to the booth with much excitement ready to purchase some jewelry like her friend had.............One lady picked out pieces for the ladies that were not coming to the show. You see they were a group of lifelong friends that were celebrating a "50" party.....All having turned 50 years young in the last year. Most had been friends since childhood with newer ones coming aboard as school and college years came and went, but they were a group of steadfast friends that had shared births, deaths, marriages divorces,,,,,,the group numbered over 10! I thought of how lucky they were to have had so may friends for so many years. The Aqua Earring Sea Glass Lovely Lady who had lead them there soon appeared sporting her new earrings and beaming.......My hubby commented with a Billy Crystal type comment (meant with all good intentions) of "You Look Fabulous", or Beautiful or something liked that...He later mentioned that he saw her tear up when he said this and that he was a bit stunned..... thinking he may have said something wrong............

I Came to find out from her friend that she had indeed lost her husband in the 9/11 attract on the Pentagon in Washington. A career officer serving his country - at last from a desk and no longer in combat (ironically his wife probably worried more about his commute to the office)... he was instantly killed when the plane hit the pentagon on that clear and lovely September morning,,, leaving our lovely aqua sea glass lady husband-less and his 3 children fatherless.......Forever! The tear my hubby witnessed may have been from a line her hubby said to her or just the sheer fact a man was saying she looked lovely,,,,,,but as a stalwart man on hearing my recount, my Jim was moved to tears as well.On hearing this I was immediately broke to tears and confided in her friend that I was glad her friend did not share it directly as I would have broke down and cried like a baby......she said that her friend had come back so thrilled and happy with her aqua and end of day jewelry purchase that they all were moved to come and get a piece of their own....

The Second Encounter - Later in the day when we were slowly closing down and I stopped to talk to the "famous" Chicken Lady,,,, an artist that features colorful graphic chickens in her large scale paintings...... I had stopped by her booth many times to admire her vivid and moving work and never questioned just why I liked it so much... It was BOLD, Inventive, totally different, but there was some other quality that attracted me to the paintings....

On this casual trip I noticed that she had posted a calligraphy framed explanation titled "Why Do You Paint Chickens"...on reading it I was moved again to tears for the 2nd time that day...I cannot recall the EXACT words.

After a failed marriage, careers and the loss of her most favorite person in the world, her older cousin (whom she had always aspired to be) along with 2 other cousins in an 18 wheeler accident that tragically took all their lives. , she found herself wallowing at her South Carolina country home, stomping the ground, crying to the heavens about how horrible everything was, how unfair to have her cousins taken so short of a full life, why didn't god take her instead of her wonderful exuberant favorite cousin, commiserating in her failed marriage, overweight, miserable, she said she stomped the red clay ground asking why were things so unfair and asking the heaven's what to do,tears streaming down her face she heard CLEARLY in her head, "Why not paint chickens?????"..............dumbfounded,,,, and doubting her own sanity, she glanced around at her Guinea hens all staring at her in her tirade,,, and the only thing she could think of was,,, "WHY NOT"...............

Believe it or not this began a new career of painting marvelous, whimsical yet, somehow serious chicken paintings...She has been featured in Southern Living several times, won numerous awards, and is a delight to share time with...The thing that really stuck with me is she told me she put that sign up because people continuously asked her "WHY DO YOU PAINT CHICKENS?.............", she turned to me after recounted all of this very personal, very emotional history and said, you know every artist has a reason why they do what they do",,,,,Why do you work with Sea Glass?"................HUM, I thought,,, Why do I work with sea glass.............I mean it has been a good 18 years and thousands of pounds what seems like a million pieces made and sold, but have I ever bothered to ask myself why,,,,,,,,,????????I thought for a moment and answered with something like,,, Well, I was attracted to sea glass because it was something that people had discarded, something left for trash, that time and nature made into something beautiful... I have always been attracted to found object art whether it was sculptural metal from junkyards, or otherwise.......And then I remembered my 9/11 Aqua sea glass lovely lady that lite up so much upon being complimented on her earrings..."well I said, though I am a bit jaded to sea glass having acquired so much of it and sold it for so long, I still see how it effects people,,,,,,,,,,,,, now granted I am not "new agey" in any way, but something about sea glass sooths people, and I am glad I can pass that along...Well, I was stunned with my eloquence, but thought of these 2 encounters on the 1100 mile trip all the way home. One woman who lite up brighter than the aqua sea glass she had purchased from me and one that asked my "Why"... Why do you do it?I want to thank both of these beautiful amazing ladies for making my trip the best!

Sea Glass Collecting On The Outer Banks

Collecting Sea Glass On The Outer Banks

We recently went back home for a vacation on the Outer Banks Of North Carolina. When I first heard the weather report, I was thrilled, hard North East winds for the weekend we arrived which usually means GREAT sea glassing once the ocean calms down.

Well, the ocean NEVER did calm down. An unnamed storm hit the OBX and slammed it for the entire week.

Generally, 2-3 days after a "typical" Nor Easter (named for North Easterly Winds) the sea glassing can be AWESOME. Sloughs that collected quartz pebbles get pushed up on the beach once the wind calms down and this is where the most amount of sea glass can be found.

Many times there can be several lines pebbles, a high high tide, a low high tide and another line right where the waves are currently breaking. The High high tide line brings the larger pieces of glass as it was deposited when the waves where at their strongest. This line also has large driftwood and even baseball size quartz stones. The other lines have jewelry size pieces.

In some areas like South Nags Head, the pebble lines can run up and down the beach instead of parallel to the shoreline and these lines can also be great for finding sea glass. This also will give you plenty of exercise as you may walk 10 times the distance going up and down the pebble lines.

This unnamed storm brought a lot of havoc to the beach in the time we were there destroying dunes, beach steps and closing Route 12 to Hatteras Island and Rodanthe on times of high tide. Blowing sand was so bad the worst day of the storm that it looked like the Sahara south the Oregon Inlet Bridge.

The new movie Nights In Rodanthe (starring Diane Lane and Richard Gere and filmed in Rodanthe around the first house in town,Serendipity) had a huge premier and opening parties on Thursday that many Hatteras Island residnets could not attend. Many of which were in the movie.

OBX'ers are well acquainted with Noreasters but the tourists we spoke to were quite panicked and many went home early.

We did manage to find a couple of pieces before the storm got going and we did find a piece that was unlike any that I had ever found in 20 years of sea glass collecting on the Banks. It was a thin piece of flash glass, with milk white and clear and was most likely a cherished house ware item that had been broken many many years ago.

This week (last week of September and first week of October) should be EPIC for finding sea glass on the OBX beaches as well as phenomenal surfing and fishing.

A couple of notes to visitors to the Outer Banks:

Please PLEASE, do not walk or play on the dunes. These are our last line of defense against the sea! I have actually seen kids boogie boarding down dunes and this destroys them and then our homes ocean side.

NO SWIMMING FLAGS

PLEASE, if the red flags are out, DONT SWIM.

On a walk down to Gary Olivers Fishing Unlimited pier on the worst day of the storm, we actually saw children jumping in the waves that were coming right up to the dunes. It only takes ONE wave to carry a child into the surf and to an inevitable drowning. Also there is tons of debris when are storm of this magnitude happens. Parts of stairs and piers with nails, sand fending Etc.... (Pictured above, 3 children play in massive tide as parents look on, notice the BRIGHT RED NO SWIMMING flags above them.

Folks, the towns do not post these flags to ruin your vacation but to protect your life! The OBX beaches can be treacherous even in the best weather!

English Sea Glass - Xtra Ordinary

Extraordinary English Sea Glass

These fascinating gems came to my attention in 2004 when a lovely family in England contacted me inquiring if I would like to purchase their sea glass. Immediately upon seeing the photos of this glass, I was awe stuck and quickly answered back a resounding "YES"!!! A friendship soon developed and I was lucky enough to become the FIRST American sea glass company to acquire this, the finest of sea glass in the world.

It is 4 years later and I still maintain the largest English Sea Glass collection of this glass in USA.

Competitors soon clamored for this lovely glass and though it is now available through other companies, we still offer pieces beyond compare of the competition. We offer many large pieces of mixed end of day sea glass and rare earring matches in many colors including Mutlis and rare reds as well a Ultra Rare pieces in pendants and necklaces.

Traveling To England

In 2005 I was fortunate to travel to this lovely seaside town in Northern England.This nondescript beach is typical of English beaches, rocky, cove like and surrounded by cliffs and hillsides. When descending the main road though town you are first struck by the level that you must descend to reach the beach. Huge cliffs of solid rock, the same cliffs that once held the Victorian glass factory that was the origin of this sea glass.

This is a very small beach that is home to these gems, rocky and rough and pounded by the relentless North Sea. Huge boulders line the cliff side and I was told that after large on shore storms, massive boulders can even be washed up on the promenade! Though to my eyes it look surfable, I was told that only once did a surfer attempt it. Cold and frigid is the North Sea and the same boulders that line the shore also lay on the bottom of the shore. It is these same boulders and rocks that are part of why this sea glass is of such magnificent quality!

I was actually more fascinated by the rocks at first and had a hard time spotting anything but greens and whites but soon developed an eye for the famed Multies (just featured in Augusts National Geographic Magazine). It is actually illegal to collect the rocks from this towns beach but I did accidentally pocketed a few. Beautiful blues and grays in the smoothest pebbles you have ever seen.

On the second or third trip, I did manage to find a large red piece wedged high in the large boulders near the cliff side.

This can be a dangerous beach to comb on if you are not aware of tides and time, my friend even recalling a time she was almost swept out to sea by a rouge wave in winter time filling her Wellies with water and losing a nice bad of sea glass to boot (pardon the pun).

The best beach to find the gems lays right down from the town promenade, another more remote beach that had earlier glass production, yielded larger pieces of seafoam green and aqua but it is a hard trek to get to and looks as if it is from another planet. A WWII bunker still sits on the beach surrounded by yet even more pebbles.

Origins Of English Sea Glass

Unlike American Sea Glass, English Sea glass from this small location, most of this glass was never made into a final product. Our glass originated as bottles and jars broken and tossed into the sea. English sea glass were lumps of molten glass, pontil rods, broken end of day pieces and chunks of leftover end of day glass.

Between the period of 1870 and 1930, a glass factory stood on the cliff in this small sea side town. When glass production first started, they specialized in decorative housewares for the Victorian market. Vases, bowls and frilly and colorful glass wares were the main product. A nearby glass museum houses some of the treasures still. Through the life of the factory, they made everything from bottles for ale, television tubes and scientific glass though decorative glass remained the largest (and most colorful) glass product.

The area was prime for glass making and even has Roman glass dating even further back. Coal mining on the hillsides and mines provided fuel for the kilns, a harbor in the center of town, provided the transportation to ship their products elsewhere. At the end of the day, the glass blowers and kiln workers would be given left over glass to ply their art. These pieces were taken home, given as gifts and even sold at market.

Many of these were known as whimsies and included items though beautiful, were impractical. Items such as glass canes (photo of glass cane sea glass piece to come) glass pipes glass dumps (paperweights with blown designs inside) and other assorted pieces. Locally there was an item called a "pitchy dobber" a flat pressed glass pieces used by girls to play a version of hop scotch. (see photo right, glass canes and pipes ). Many of these items did not make it into homes as they were broken in production. These then too were cast into the North Sea to become our sea glass treasures and can still be found on this beach today.

During our trip, we found the remnant of a glass dump, a once if a lifetime find tough I have been told another has been found since.

Sea glass was once so prevalent in this area that the local cemetery has graves that are covered with the more common colors of sea glass. As the demand for these gems has grown, theft shortly followed of the rarer colors. Before we started marketing these Extraordinary sea glass gems on our site, the value of this sea glass was very low. The town did not know what a treasure they had. Once we started posting jewelry online, the demand increased 100 fold and competitors soon clamoured for the fascinating and rare sea glass.

Our once cherished source and friend became so sought after that we could no longer be the only source in the USA but we still maintain the largest collection with over 100 pounds of English Sea Glass.

We are the ONLY professional company to offer Ultra Multi Rare earrings in this lovely glass and soon plan a trip back to the UK to collect our own glass once again and arrange for local collectors to once again send us the great sea glass.

English sea glass in very unique and differs greatly from our American sea glass. Our sea glass originated as bottles and jars, broken up and tumbled over many years by the surf and sand. English sea glass was never made into a product and was slag or End Of Day glass dumped into the sea from a coastal glass factory. This glass dates back to the Victorian era and has some of the most unique colors you will ever see in sea glass.

Genuine Sea Glass TM is a term that I starting using in 1990 when By The Sea Jewelry first went online. It has become the standard term to indicate that sea glass is natural found glass just the way it was picked up from the beach. Other terms include, natural sea glass, real sea glass, found sea glass, pure sea glass, true sea glass, unaltered sea glass, well,,,,,,,you get the idea.

Pictured - A rare piece of English Sea Glass that was once a pontil rod. Pontil Rods are glass rods used to turn glass in a kiln. They are usually discarded, in this case, into the sea. This piece is quite rare as most pontil rods are less expensive colors of glass(like white).

Genuine Sea Glass TM (or whatever term you use) means the glass in your jewelry is unaltered from the way it was found on the beach (uncut or tumbled by any artificial means). Real natural sea glass comes from old bottles, jars and other glass items that have been discarded in the ocean and tumbled naturally by waves and sand over many years. It can take many decades for sea glass to be formed.
